In details: Plan of UN Support Mission for solution in Libya

The UNSMIL proposal paper sent to the Berlin conference organizers for the 2020 international conference on Libya included suggestions of dissolving all the current executive authorities and uniting all state institutions plus amending the Presidential Council’s structure into 2+1 members – new Head and two deputies.

The paper says the new Presidential Council’s Head will form the government as per the “understandings reached in Tunisia on November 2017” and then the government should be approved by the House of Representatives with two thirds’ majority, if not, the government will be endorsed automatically.

The paper, of which 218News got a copy, called for ending the transitional phase in Libya and ending the mandate of all municipalities before mid-2020 as well as activating Law No.59 to form the High Council for Local Governing.

Economic Track

Talking about economy, the paper called for taking serious steps to unite the Central Bank of Libya before holding the Berlin conference and to carry out the auditing and revision process by international firms as well as to commit the CBL Board Members to the Libyan laws and regulations, calling at the same time to improving the transparency in the work of the National Oil Corporation and to provide support for the oil sector to increase production.

It also proposed forming Construction and Building Fund in Libya to facilitate spending on infrastructure and vital institutions as well as forming a Libyan economic experts’ committee based on the geography of the country.

Security Track

The paper proposed a ceasefire and a need for efforts to achieve stability across Libya as well as rebuilding state institutions to be under legitimate force command, saying this track should be coupled with the political one.

It says there should be a joint 5+5 military committee from the army and the police under the auspices of the UN based on the recommendations of Cairo meetings. The committee forms work teams to establish truce, disarm groups and readjust fighter into state institutions, let alone fighting terrorism and executing the security arrangements and securing borders.

The second phase is announcing a comprehensive ceasefire and evicting foreign fighters from the frontlines plus holding talks under the auspices of the 5+5 committee.

Committee of Releasing Fighters

The committee will gather details about the number of armed groups in cooperation with the Interior Ministry, Defense Ministry and General Command with a team depicting the criminal and terrorist members among the groups to single them out. In addition, the teams will set rewards and assurances for the armed groups in order to get them to cooperate and will tackle the injured fighters’ program as well as releasing the underaged fighters.

The Defense and Interior Ministries of the new national unity government will tackle the implementation of the security arrangements.

Arms Embargo

The paper explained the arms embargo in Libya is to be blamed on the Security Council member states and said the countries taking part of the Berlin conference should commit to this embargo, besides developing the panel of experts’ mechanisms and appointing contact points with the panel inside Libya as well as appointing an international committee from the countries attending Berlin conference to secure the Libyan land, marine and air borders.

International Humanitarian Law

The UNSMIL’s paper also urged for supporting the judicial institutions and for taking necessary steps to end arbitrary detention of immigrants and refugees as well as to shut down the detention centers in the country by building alternatives. In addition to documenting violations of international humanitarian law and holding the perpetrators accountable.

The paper indicated that there should be a UN-led committee to be formed by the Human Rights Council that will be convened in March 2020, besides the formation of a special court that tackles impunity in war crimes and crimes against humanity as well as violations of human rights.
