Al-Mashri urges HoR Speaker to achieve consensus for amending constitutional declaration

The Head of the High Council of State, Khaled Al-Mashri, sent an official letter to Aqila Saleh, the Speaker of House of Representatives, inviting him “to implement what was stated in the political agreement included in the constitutional declaration.”

The House of Representatives met Monday in the city of Sirte in the presence of “132” MPs to discuss granting confidence to the government of national unity headed by Abdul Hamid Dbeibah. The session resumed Tuesday.

Al-Mashri assured in his message to Saleh that “the High Council of the State will deal with the proposed amendment to the Constitutional Declaration as stipulated in the agreement, which is one of the main references for the political process.”

Al-Mashri said that he welcomed the convening of the parliament session in Sirte, saying: “We hope to return to the completion of the upcoming benefits in agreement with the High Council of the State in accordance with the political agreement”.

The Head of the High Council of State referred to what came during the parliament session regarding voting on a constitutional amendment affecting the political agreement, stressing the principle of partnership stipulated in the political agreement, and what was stated in Article (12) of the agreement, which states that all institutions stipulated in The Libyan political agreement has its legitimacy from the Constitutional Declaration as well as its amendment attached to this agreement, after its approval and approval in full, its signature and entry into force .. and in the event that a subsequent amendment to the constitutional declaration is required that affects the agreement or one of the institutions emanating from it, directly or indirectly, the House of Representatives and the High Council of State are bound by consensus to formulate this amendment provided that it is finally approved, without modification, by the House of Representatives in accordance with the mechanism contained in the Constitutional Declaration.

Al-Mashri concluded in his letter to alert the Speaker of Parliament that: “In order to avoid constitutional challenges that may affect the individual amendments to be made by the Parliament, we invite you to implement what was stated in the political agreement included in the constitutional declaration, and the Supreme Council of the State will deal positively with the proposed amendment draft”.
