Libyan Supreme Judiciary Council decries plunging judicial authority in political quota

The Supreme Judiciary Council in Libya issued a statement confirming its rejection of the understandings reached by the Libyan parties in Bouznika, Morocco, which are based on the division of the positions of the sovereign institutions on the principle of territorial quotas and geographical distribution, stressing the need to allocate positions on the basis of competence.

The council’s statement, issued on Sunday, condemned the inclusion of the judiciary in political polarization, stressing that the work of the judicial bodies and their presidency are organized by laws, and it is not possible in any way to rely on the opinion of any group here or there that does not take the form of a law issued by a unified elected legislative council and is included in a permanent constitution in the country.

The Supreme Judiciary Council indicated that the judiciary in Libya is the only authority among the three authorities elected, that works in accordance with the law, and has preserved its unity; warning that targeting it with this distribution constitutes a real threat to its unity and independence, which is considered a violation of the constitutional principles that have been safeguarded by striking at the coherent fabric of the judicial authorities in Libya, in the east, west and south.

This statement comes against the background of the agreement of the House of Representatives and the High Council of State’s delegations last Saturday, during their talks in the Moroccan city of Bouznika on the geographical division of the senior positions of the leading institutions of the country.

They agreed that the Tripoli region, according to the historical division, would be granted the positions of the Attorney General, the Audit Bureau and the High Elections Commission, while Fezzan is awarded the Supreme Court and the Anti-Corruption Commission, and Barqa (Cyrenaica) is awarded the Central Bank and the Administrative Control Authority.
