Controversy over candidacy of Supreme Court’s Head to new Presidential Council

Interference in the authorities and a break of norms in the Libyan political scene, the most recent of which was the announcement of the President of the Supreme Judicial Council and the President of the Supreme Court, Counselor Muhammad Al-Hafi, to run for the positions that the UN mission announced.

Hours after the announcement of the final list of candidates, the Libyan Association of Judicial Bodies issued a statement denouncing Al-Hafi’s candidacy for the prospective presidential council, noting the contradiction in the possibility that the head of the judiciary could be the head of the executive at the same time, pointing to the confusion between two of the state’s main authorities.

The statement did not conceal the question of the association’s members about the future of the judiciary in the event that he did not win the elections and did not grant confidence, and about how the Constitutional Department looks into any appeals that may be presented in the election results at a time headed by one of the contested candidates, which may lead the judiciary to solve the disputes of political policy, to transform from a tool for implementing the law and achieving justice into a tool for violating and violating it.

The Libyan Association of Judicial Bodies’ statement called for the immediate withdrawal of his candidacy or the announcement of his resignation from the presidency of the Supreme Judicial Council and the Supreme Court in order to preserve the prestige and independence of the judiciary.

It called upon the General Assembly of the Supreme Court and the Supreme Judicial Council to convene urgently to take a decisive position that preserves the integrity, prestige, independence and impartiality of the judiciary even if this cost them the dismissal of Al-Hafi and his suspension from work if he refused to withdraw his candidacy.

The statement denounced the silence of the Judicial Society, which it described as unpalatable, and demanded the UN mission not to prejudice the judicial authority.
