Attorney General prohibits Public Prosecution members from running for parliamentary elections

Libyan Attorney General Al-Siddiq Al-Sour issued Tuesday a decision banning members of the Public Prosecution from running for Parliament elections, as long as their membership is in effect, calling on the Department of Inspection of Judicial Bodies to file a public lawsuit against members who are proven to be seeking candidacy.

Al-Sour considered that the candidacy of members of the Public Prosecution for elections would violate the principle of equality among the candidates; in view of their knowledge of the tasks of investigating crimes and electoral appeals, in comparison to the law prohibiting the candidacy of members of the High Electoral Commission, which is responsible for supervising and implementing the electoral process.

He added that the candidacy of members of the judicial bodies will lead to the opponents’ belief in the impartiality of the electoral appeals bodies, when the opponent is a member of a judicial body, and that the requirement to obtain the recommendation of one hundred voters for the candidate will affect the behavior of the member of the judicial body.
