Parliamentary committee unveils forgery, weapons and uncertainty of elections in Libya

The parliamentary committee formed for the purpose of following up on the electoral process issued its report containing its observations on the performance of the work of the Electoral Commission, in addition to its recommendations with the aim of advancing the electoral process.

The report accused the High National Elections Commission of violating some articles of Law No.1 of 2021 with the conditions for accepting candidates, which plunged them into a cycle of appeal and counter-appeal. It added that the Commission’s statement regarding setting the date of the vote was political, and did not specify the force majeure that made it impossible to hold the elections.

The report also stated that the Commission’s report proved the existence of cases of fraud in the documents submitted to the Commission, stressing that these documents had been submitted to the judiciary and were not considered, saying that the commission’s lawyer was prevented from pleading before the appeals committees with threats and fear of the security consequences of his defense against one of the candidates.

The report attributed the commission’s inability to abide by the provisions of the law and its inability to meet the election deadline to the reality on the ground that is governed by weapons outside the control of the law, and controlled by parties that do not want to implement the law, accusing the Prime Minister of violating his pledges in front of the dialogue forum, which led to a violation in equal opportunities among candidates for the presidency of the state.

The report emphasized that the House of Representatives cannot interfere in judicial rulings, and it will continue its work as a sponsor of the political and legislative process and will refrain from engaging in political dates set by some parties for the purpose of local media or international attention.

The report added that reliance on any particular date for holding the elections in light of the current security and political conditions is a repetition of the failed experience that the Commission led, based on an ill-considered decision issued by the Libyan Political Dialogue Forum under the auspices of the United Nations Support Mission.

In its report, the commission recommended the development of a new, realistic and applicable road map, set with durations and stages, not dates and timings within a constitutional framework, to ensure the success of the electoral process.

The committee also recommended amending the draft constitution through a joint committee between the House of Representatives and the High Council of State, so that the draft constitution would be reconstructed in the higher national interest.

The committee concluded its recommendations by calling for the restructuring of the executive authority to achieve the stability that the current executive authority has been unable to achieve.
